Terms & Conditions

1. Definitions:
‘Member’: Qualifying Property Owner subscribing to the Service for Renting or Swapping purposes.
‘Founder Member’: A Member who joins and deposits a week before the 9/10/06.
‘Qualifying Property’, ‘Property’: Any residential property which is not a principal residence and which is used as a holiday home. This specifically excludes timeshare. It must be self contained, with its own kitchen and private bathroom, clean and comfortable, and must be looked after by a local management company.
‘Qualifying Property Owner’: Person or persons owning a Qualifying Property.
‘Our Service’: The offer of a complete holiday rental and exchange service with a worldwide choice of quality holiday homes.
‘Jolly Websites’: the websites www.JollySwap.com (JollySwap) and www.jollyrentals.com (JollyRentals).

2.Ownership:
Jolly Websites are owned and operated by Nicola Palmer t/a JollySwap.com.

3. Access and use of the sites:
Access and use of the Jolly Websites are both governed by and conditional upon your acceptance of these terms and conditions. Acceptance will be deemed to be the case by your access and/or usage of the site and further confirmed by the use of a tick box at the appropriate time.

4. Access and use:
Jolly Websites restrict access to ‘members only’ areas of the websites via the use of password and user ID. Both of these will be created by you and confirmed by Jolly Websites upon confirmation of your membership. By becoming a member you can use JollySwap and/or JollyRentals.

5. Links:
The websites have links to various organisations involved principally in the travel industry, and have been approved by Jolly Websites (e.g. flight information, car rental, and insurance websites).

6. The Service:
The service offered by Jolly Websites is designed exclusively for owners of second properties which are likely to be used by them principally as ‘holiday homes’. All types of timeshare/shared ownership/property bonds are specifically excluded.

7. Jolly Swap:
The system used by JollySwap works on a unique points system. Points are earned for all weeks deposited on the following basis:
Studio/1 bed apartment - 1 points 2/3 bed apartment - 2 points 3/4 bed villa - 3 points 5 bed villa or larger - 4 points

Points are earned on this basis for each week deposited. Points are valid indefinitely.
High Season weeks: High season weeks are defined as weeks commencing anytime on or after 17/7 but before 24/8 and on or after 19/12 but before 29/12: Double points will be earned for any weeks deposited that start on or during these dates. This only applies for qualifying property situated in Europe.
Out of season weeks: All weeks which do not qualify as high season weeks are classed as out of season weeks. All Out of season weeks deposited by Members earn quarter points per week ie: 4 consecutive weeks will need to be deposited to exchange for one week in high season.

Bookings:
All Bookings are made using the same point system. EG: A member wanting to book one week in a 5 bed villa in September will need to have deposited sufficient week(s) to qualify for 4 points.

Fees:
Membership Fee: No membership fees are payable.
Platinum Club membership: Payable at the rate of £20 per annum. For more details on the benefits of this form of membership, please click here.
Conversion fee: This is payable once a confirmed booking has been made. This fee is £45 for founder members and £69 for other members. For more details on conversion fees, click here.

Cancellation and Termination:
Cancellation: Members can at any time apply to JollySwap to remove week(s) deposited by them, and so long as the week in question has not been booked, or used by the member to secure a booking elsewhere, then, at the absolute discretion of JollySwap, the week may be taken off deposit.
Termination: JollySwap reserves the right to suspend and/or terminate your membership at any time if you are in breach of any of your obligations hereunder.

8. JollyRentals
JollyRentals advertises members’ properties in order for the member to rent out their property. Members agree to keep availability up to date at all times so visitors can instantly see if the property is available before making a booking.

Bookings: Visitors can book members’ properties by clicking on the ‘Book Now’ button and contacting the members directly to pay any deposit and complete any Booking Forms. All agreements are made directly between the member and visitor.

Fees:
Membership Fees: No membership fees are payable.
Photographs: Members can show five photographs free of charge. Members can pay a one-off payment of £20 for an additional five photographs.
Late Availability/Special Offers: Members can advertise Late Availability and Special Offers for £20 per annum. Once a member has subscribed to this service they can advertise an unlimited number of Special Offers for their property.
Commission: JollyRentals does not charge any commission to the member. JollyRentals will automatically add a ‘Booking Fee’ to your charges which will be paid directly by the visitor on booking.

11. Contents:
Copyright in the Jolly Websites, its contents design and any trademarks are owned by Nicola Palmer t/a JollySwap.com.

12 Limitation of liability:
· Limitations: The innovative service offered via this website is in essence a holiday swapping and opportunity. No contractual relationship will be created between any member and Jolly Websites beyond the terms hereby set forth. Accordingly, neither JollySwap nor its officers, agents nor employees, will be liable for any loss or damage suffered by you (or any third party) arising (directly or indirectly) from your operation or usage of the site, howsoever arising. This limitation also applies to your use of the services of any linked sites.
· Security: We undertake to take all reasonable steps to preserve the security of all information sent to us, but no guarantees or warranties are made, as internet data transmission is not totally secure.
· Indemnity: Jolly Websites neither warrants nor guarantees that all the information/details/descriptions contained within the sites is completely accurate or up to date. Usage and reliance on content is at the risk of Members.

13. Privacy policy:
The privacy of all our members is paramount. Accordingly, your personal details will never be passed to any third party, without your specific instructions to do so.

14. Jurisdiction:
These terms and conditions are governed by the Law of England. The parties accordingly submit to the exclusive jurisdiction of the Courts in that Country in the event of any disputes that may arise.

15. General:
These terms and conditions are reviewed periodically and may be revised and updated accordingly at any time.
